Terms of Service

Version 2026-07-08. Effective July 8, 2026.

Effective date: July 8, 2026. TUNC LLC (doing business as TUNC.AI, TUNC Hub), California, USA. Applies to tunchub.com, the TUNC Hub desktop application, TUNC CLI, and related services (together, the "Service").

Your work is yours. We never sell your content or your personal information, and we never train AI models on your content unless you explicitly opt in.

Plain-English Summary

  • Your work is yours. You own everything you create with TUNC Hub. We never sell your content or your personal information. We never train AI models on your content unless you explicitly opt in, and Business and Enterprise content is never used for training at all.
  • You bring the AI. TUNC Hub connects to models you choose (your own API keys, OpenRouter, local models). Model providers have their own terms and their own bills.
  • Collaboration is visible by design. People you invite can see the session. If your account belongs to an organization with access to TUNC Core, that organization's administrators can fetch session history under its policies, and the app tells you when a workspace is governed.
  • It is a beta. The Service is provided as is, our liability is capped, and disputes go to individual arbitration unless you opt out within 30 days (instructions in Section 16).
  • You can leave. Cancel anytime; paid plans stop renewing at the end of the billing period; you get 30 days to export your content after closing your account.

1. Who We Are and What This Is

These Terms of Service ("Terms") are a binding agreement between you and TUNC LLC, a California limited liability company doing business as TUNC.AI ("TUNC," "TUNC Hub," "we," "us"). By creating an account, installing the application, or using the Service, you accept these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes it.

2. The Service

TUNC Hub is a collaborative AI harness: a desktop application and related services that let people work in shared, real-time sessions with AI agents, route session traffic between participants, store shared artifacts, and, for organizations, govern usage through a policy and audit layer (the "Core"). The Service is in beta: features may change, be added, or be removed, and availability is not guaranteed. We will not materially reduce what a paid plan includes during a period you have already paid for.

3. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract. You agree to provide accurate registration information, keep your credentials secure, and accept responsibility for activity under your account. Notify us promptly at support@tunc.ai of any unauthorized use. We may suspend accounts that present a security or legal risk to the Service or other users.

4. Your Content and Our License to Operate

You own your content. As between you and TUNC, you retain all rights to the prompts, messages, files, code, images, and other materials you submit or generate through the Service ("User Content").

Our license is only what operation requires. You grant TUNC a limited, non-exclusive, worldwide, royalty-free license to host, cache, route, transmit, display, and back up User Content solely to operate, secure, and improve the reliability of the Service, including displaying it to collaborators you or your organization authorize. This license ends when the content is deleted from the Service, except for transient backups purged in the ordinary course (no more than 35 days).

Our commitments, stated as obligations: (a) we do not and will not sell User Content or personal information, and we do not share either with third parties for their advertising; (b) we do not use User Content to train or fine-tune artificial intelligence models unless you first give explicit, informed, opt-in consent through an account setting that defaults to off; (c) content belonging to Business and Enterprise plan accounts is excluded from any such training regardless of settings; and (d) aggregate, de-identified operational statistics (for example, feature usage counts) that contain no User Content and cannot reasonably identify you are not User Content and may be used to run the business.

Your responsibilities. You are responsible for having the rights to what you submit, including your clients' confidential material, and for complying with laws that apply to your content and your use.

5. AI Models and Third-Party Services

The Service connects to AI models and services you select, including through your own API keys, third-party routers, and locally hosted models. Those providers are independent: their terms, privacy practices, pricing, and rate limits govern your use of them, and charges they bill you are yours. AI output can be wrong, incomplete, or unsafe for a given purpose; you are responsible for reviewing output before relying on it or shipping it. We do not guarantee any particular model's availability through the Service.

6. Collaboration, Organizations, and Visibility

Shared sessions are shared. Participants in a session can see its messages, artifacts, and activity, and may retain copies. Invite only people you intend to see the work.

Governed workspaces are visible to the organization. If your account or workspace belongs to an organization operating a Core, that organization can apply policies and its authorized administrators can view session history, usage, and artifacts within that workspace under the organization's own policies and applicable law. The application indicates when a workspace is governed. If you use an employer-provided account, your employer's policies and notices, not these Terms, define what it may view; organizations deploying the Core are responsible for providing legally required notice to their users.

Guests. Guests join under the host's plan and policies; the host is responsible for what guests are shown.

7. Acceptable Use

You will not use the Service to: (a) break the law or infringe others' rights; (b) create or distribute malware, or conduct denial-of-service, spam, fraud, or unauthorized-access activity, including orchestrating agents for those purposes; (c) probe, disrupt, or overload the Service or circumvent its limits, quotas, or policy controls; (d) misuse another person's personal data; (e) resell or white-label the Service without a written agreement with us; or (f) develop a competing product by systematically extracting the Service's non-public behavior. We may investigate violations and suspend or terminate accounts that commit them, with notice where practicable.

8. Plans, Billing, and Storage

  • Plans and prices are listed at tunchub.com/pricing. Paid plans bill in advance, monthly, per seat or per account, and renew automatically until cancelled. Taxes may apply.
  • Cancellation. Cancel anytime in your account settings; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable for partial periods.
  • Price changes take effect at your next renewal and only after at least 30 days' notice.
  • Storage. Plans include stated storage allowances; paid upgrades are available. If you downgrade or lapse below your stored volume, you will have at least 30 days to reduce or export before over-allowance content may be deleted, with notice first.
  • Free plans are provided without charge and without service-level commitments, and their allowances may change with notice.

9. Privacy

Our Privacy Policy at tunchub.com/privacy describes what we collect, why, how long we keep it, and your rights, including deletion. It is part of these Terms. Its core commitments match Section 4: no sale of personal information or User Content, no advertising use, no AI training on User Content without explicit opt-in, and Business and Enterprise content excluded from training entirely.

10. Intellectual Property and Feedback

The Service, including its software, design, and branding, is owned by TUNC and its licensors and is licensed to you, not sold. We grant you a limited, non-exclusive, non-transferable license to install and use the application to use the Service under these Terms. You may not reverse engineer the software except where the law grants that right notwithstanding this term. If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without obligation to you; feedback never includes your User Content.

11. Beta Features and Changes

Features marked beta, preview, or experimental are provided for evaluation, may be less reliable, and may be changed or withdrawn at any time. We may update the Service, and the application may install updates automatically where your operating system permits.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for material breach of these Terms, legal requirement, or risk to the Service or others, with notice where practicable and, for curable breaches by paying customers, a 14-day cure period. After account closure you will have 30 days to export your User Content, after which we may delete it. Sections that by their nature survive (including 4's commitments as to content we still hold, 10, 13, 14, 15, and 16) survive termination.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUNC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING, INCLUDING ANY WARRANTY THAT AI OUTPUT WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA; AND (B) TUNC'S TOTAL LIABILITY ARISING FROM THE SERVICE IS CAPPED AT THE GREATER OF ONE HUNDRED U.S. DOLLARS OR THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. THESE LIMITS DO NOT APPLY TO A PARTY'S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, TO YOUR PAYMENT OBLIGATIONS, OR WHERE THE LAW FORBIDS THE LIMIT.

15. Indemnification

You will defend and indemnify TUNC against third-party claims arising from your User Content, your violation of these Terms or the law, or your misuse of the Service, except to the extent the claim results from our breach of these Terms.

16. Disputes, Arbitration, and Class Waiver

These Terms are governed by California law. Before filing any claim, you agree to contact us at legal@tunc.ai and give us 30 days to try to resolve it informally. Except for small-claims-court matters and either party's right to seek injunctive relief for intellectual-property misuse, any dispute will be resolved by binding individual arbitration administered by JAMS in Los Angeles County, California, under its Streamlined Rules, and BOTH PARTIES WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. For consumer users, TUNC will pay arbitration fees that exceed the cost of filing in court. Your right to opt out: you may reject this arbitration section, keeping all other Terms, by emailing legal@tunc.ai with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms.

17. Changes to These Terms

We may update these Terms. For material changes we will give at least 30 days' notice by email or in the application before the changes take effect, and your continued use after the effective date constitutes acceptance. Changes will not be retroactive, and no change will remove the commitments in Section 4(a) through (c) for content already on the Service without your fresh, explicit consent.

18. General

These Terms plus the Privacy Policy are the entire agreement between you and TUNC about the Service. If a provision is unenforceable, the rest remains in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets, in which case your Section 4 protections carry over to the assignee for content then on the Service. Failure to enforce a provision is not a waiver. Notices to us: TUNC LLC, legal@tunc.ai.
